STFBC Secures $4 Million Settlement in Complex Workplace Case

Attorneys Gary Fox and Michael Levine at Stewart Tilghman Fox Bianchi & Cain, P.A., along with Marc Brumer of Brumer & Brumer, reached a settlement on behalf of an Amazon employee who was struck by a third-party trucking firm called Ogun Transport. The truck driver backed the truck into the plaintiff, crushing his lower leg. Our investigation revealed that the truck’s backup alarm wasn’t working, and the truck driver broke the law.

The accident left our plaintiff with a significant disability and serious pain and suffering. After hospitalization, he required months of rehab and numerous surgeries to restore his leg. Even after all his care, it’s likely that our client will never regain full mobility.

“We were very aggressive in discovery in getting the information about the driver, what happened and where he’d been,” Michael said to Daily Business Review. The firm found that the truck company didn’t maintain proper logs and the driver had been behind the wheel for 15 hours—4 hours longer than federal law allows, and he had his girlfriend in the cab beside him. It became clear that what happened to our client was the result of unlawful negligence.

“So, from our perspective, you had a driver who was tired, broke the law, and then was distracted because he was driving with his girlfriend in the cab,” Michael said. “And that’s how mistakes are going to happen.”

This case ultimately illustrated that, in egregious cases with aggravating factors, workers’ compensation isn’t the only source of recovery available to injured workers.
