Miami Burn Injury Attorneys
Providing Assistance & Demanding Justice for Burn Victims in Florida
Even after a burn victim recovers from their injuries, they are often left with permanent reminders. Scars, disfigurement, and other medical complications are common hardships experienced by survivors of severe burns. Stewart Tilghman Fox Bianchi & Cain was founded on the principle that people deserve quality legal representation. Specifically, we believe that our clients deserve aid and justice, and we know that no one deserves to suffer due to the irresponsibility of others.
Negligence in burn injury cases has five elements to it:
- Duty – The wrongdoer had a responsibility to preserve the safety of the burn victim.
- Breach of Duty – The wrongdoer was careless or willfully failed to uphold their responsibility.
- Cause in Fact – The victim’s injuries are a direct result of the opposite party’s actions.
- Damages – The victim suffered physically, emotionally, or financially. These damages must be verifiable to establish that the negligent party owes actual damages.

Different Type of Burns
Since they manifest with different symptoms and levels of severity, burn injuries are separated into four main categories. These categories consider factors like a burn’s depth, size, and other symptoms to define the severity of the injury. Burns most often result from contact with heat sources, chemical sources, or explosions. Burns are categorized as follows:
- First-Degree Burns: First-degree burns occur when the skin briefly contacts a hot surface. Though they are a minor type of burn, these injuries can still be painful. However, they rarely result in complications that require serious medical attention and only require basic first aid. Signs of a first-degree burn include swelling and red coloration.
- Second-Degree Burns: Second-degree burns extend past the first layer of skin. These burns commonly cause blistering. This is the body’s attempt to heal the injury and protect the lower layers of skins. Care for these burns does not always require professional medical care. However, if the burn is large enough, a trip to the hospital may be necessary.
- Third-Degree Burns: Third-degree burns are severe medical emergencies and require intensive treatment to heal. Third-degree burns cause damage to every layer of the skin and damage nerve ending and tissues underneath the skin.
- Fourth-Degree Burns: Fourth-degree burns are similar to third-degree burns, but they represent an even more dangerous level of injury. With this type of burn, the damage may extend past the skin and into the muscles and bone. This burn may cause so much damage that healing is not a possibility. Fourth-degree burns often require amputation.
The Lifelong Repercussions of Burns
Even if a victim fully recovers, the damaged skin usually does not heal back to its original appearance. Burn scars are notorious for causing physical and emotional trauma. Physically, burn scars can produce tighter skin and limit physical movement. Emotionally, some burn victims suffer a heartbreaking amount of shame due to the embarrassment of regarding visible scars. In severe cases, burn victims socially isolate themselves, having a substantial effect on their life.
Other burn injury complications include:
- Sepsis
- Dehydration
- Amputation
- Respiratory Infection
- Pulmonary Disease
Burn Injury Treatments
Due to their complex and devastating nature, burn injuries require an extensive healing process. Burns that are third-degree or deeper often require skin grafts, amputation, and reconstructive surgery to treat. Medical bills can be astronomically high after treatment has begun. The most intimidating aspect of recovering from a burn is that bills can continue to climb as complications occur, and further health care is needed. When someone is unable to work due to their injuries, debts may become increasingly unmanageable—leading to financial instability and bankruptcy.
Can I Seek Compensation for My Burn Injuries?
Absolutely. In many cases, seeking compensation triggers a change in the way that a company or city operates, creating a safer community. We believe that no one should have to suffer financially from the irresponsible actions of others. Those with burn injuries may be unsure if they can pursue the recovery of damages for their pain and suffering.
We have helped our clients seek compensation for:
- Pain and suffering
